            VANCOUVER — Lawyers for Ticketmaster Canada customers who sued over the company's sales and pricing practices say there's a tentative settlement of class action suits launched in four provinces.

            If the courts approve the deal, customers who bought qualifying tickets on www.ticketsnow.com will get automatic refunds, even though Ticketmaster says it didn't do anything wrong.

            The settlement calls for people who bought tickets through the company's secondary site Tickets Now to get a refund of $36 per ticket. The settlement does not cover tickets sold over the Ticketmaster website.

            The first of the court hearings required before the settlement can be finalized will take place in Ontario on June 29. Other hearings will be held in Quebec, Manitoba and Alberta.

            This is what happens when a monopoly is allowed to go unchecked. They get exclusive rights to sell tickets for an event, they get to nickel and dime you for every fee they can imagine.

            Hey, it must be worth it when you sit for two to three hours watching a sporting or music event, when you're already paying over 100 bucks to rent a pop-covered folding chair with no back support.

            I am going to begin this post a bit untraditionally with an email cut and pasted in its entirety, sent to me by my friend who was going with me to the show. She agreed to go to the show over two months ago when I was buying tickets. She trusted my judgement (as she has in the past) and although never having heard of St. VIncent, agreed to go. I gifted her some of the music two days before the show and this is what her review was (which I received in the email below just two days prior to the show):

            THE EMAIL:

            "Will you totally HATE me if I back out of the concert? If so, I will go.

            I DO NOT LIKE HER MUSIC - at all.

            I'm sorry but it even scared my cats. :) Seriously, they looked around for the source of the sounds. It was actually pretty funny.

            I will go if you will hate me or threaten to never speak to me again but otherwise I'd like to back out. If you can't sell the ticket at the door then I'll pay you for it. If I was the only one going with you then I'll go b/c I don't want you to go alone after I said I'd go with you.

            I like to think that I'm pretty open but she just sounded like noise to me and I can't image it live."


            My reply was something like: That is totally not cool. I will sell the ticket and I will hopefully, eventually, in this lifetime, get over your blowing me and the concert off. Don't worry about it.

            Her reply was something like: I will go to the show, never mind.

            We went back and forth like this for a while, me sending her the New York Times review, another review giving high marks to her latest release, and then it was settled that my company alone made it worth going to the show (after all, I am fun... at least some people think so). It is always good to keep your friendships intact (at least ones you care about) and it is always good to maintain your concert invitation cred. Once you commit, just grin and bare it. Unless of course there is a death in the family, you find yourself in the hospital due to the need for emergency appendectomy surgery, or other worthy reasons to back out.

            I do agree that you could have a love or hate, polarizing opinion, of St. Vincent (Annie Clark) but that email was a bit blunt/harsh/a bit shall we say RUDE, even for me. I mean her cats hated St. Vincent?? What if St. Vincent was my all time favorite band? What if Annie Clark was, in fact, my sister? The show was in actuality sold out - can everyone else be wrong?

            St. Vincent is the recording project of Annie Clark (born 1982, in Tulsa, Oklahoma), a one-woman band who mixes pop balladry, showtune-ish exuberance, squalling electric guitar, and subtle hints of jazz in her particular, complex compositions. Based in Brooklyn, but raised in Dallas, Clark had, before finding fame as St. Vincent, done time in robe-wearing sunshine-pop cult The Polyphonic Spree, and in the live band for banjo-pucking boy-genius Sufjan Stevens.

            She took her stage name from St. Vincent's hospital in downtown New York, the place where, amongst other things, poet Dylan Thomas spent his final hours. The joke being that Clark's music is "the place where poetry comes to die."



            There was a long time to wait after suffering through Welsh singer Cate Le Bon, who was very monochromatic playing what sounded like the same song over and over. She was in need of a great band to offset her lack of diversity. The audience was extremely polite nonetheless (everyone clapped and no one "booed" her off stage). St. Vincent hit the stage close to 10:30 (late for me on a work night but muster on we would).

            Clark performed mostly new tunes and did not play audience favorites like "Paris Burning". The sound was off for the show and hard to ignore. The base was way too loud and Annie had what seemed to be continuous issues with her ear pieces since she was always readjusting them. She even hit a long note off-key which certainly had to do with her earpiece and not her ability to reach a high note. There were also points during the show that you could not hear what she was saying during her occasional comments to the audience. The lighting was a show in and of itself and one of the best things about the performance often draping Clark in multiple hued spot lights proposing a magical and haunting quality to the stage. But the never ending fog machine needed to be turned off at some point. So unfortunately, due to poor soundmanship, it was hard to hear how great she is and great lighting can only get you so far as a distractor. The Metro was indeed packed to the gills with hundreds of appreciative fans just glad to get a ticket (face value only $18). A few years back she did an acoustic show at Schubas which must have been a great way to see her sans loud electronica base sounds and fog.

            I would give St. Vincent another chance but it would have to be at a smaller venue (would she ever play at Lincoln Hall?). Metro disappointed as a venue and usually the sound is great. She is adorable and plays a mean electric guitar often making it into a sound effects machine. Her virtuosity on guitar is as notable as her quirky and often eery lyrics. Clark uniquely combines the genres of jazz, indie-rock, electronica, and punk vibes into her songs. You have to give her songs a thorough listen to appreciate her haunting poetry. She does lean towards the dark side which is unexpected if you were to judge based on her pretty doe like Disney face and small frame. This performance gets a 3 out of 5 guitar rating due to poor sound that was hard to get past. My friend did survive the concert. She thought there was a possibility that St. Vincent could grow on her and that maybe even the cats would be less scared over time. Still not a glowing review. Oh well, you can't please everyone all of the time.

            Zee was a delight to see and hear live. Her vocal style ranges from pop folk to classic jazz. She also plays a mean kazoo (claiming that she did not have a trumpet player and playing the kazoo as an ample replacement). She is known for her sweet acoustic songs that she plays with her ukelele but she is just as proficient on guitar. She was completely comfortable on stage and despite her petite 4 foot plus size had full command of the stage and show. She talked to the audience throughout her set and was engaging at all times. Before the show she was standing by the bar sipping her whiskey straight up. She had a little spill and dropped her Ukelele. I offered to run home and get her one of my kids lesser quality ukes in the event it was broken. Fortunately (for her and the audience), her fine instrument survived the tragic fall without need of repair.

            Zee gets a 5 out of 5 guitar rating. Can't wait to see her again.

            The Civil Wars and Milo Greene at the VIc Theatre on 11/6/11

            My friend Amy and I had the grandiose idea that we would eat at DMK Burger Bar before the show. It is on Sheffield and Wellington (Wellington being a good place to park if you have a 383 parking permit). I have eaten at DMK several times for lunch and never had to wait for a table. Sunday night at 6:30 = 45 minute wait time. My bad. Anyway, the problem was resolved by heading a couple of doors down to the Kirkwood Bar and Grill(previously Pops for Champagne). We recommend the fish tacos (your choice of three) and the greek salad. The steak flat bread was well, flat. A little seasoning and/or marinade might have helped. Nonetheless, either place is a good call before hitting the Vic for a show.

            I rarely open by blog review by discussing the opening act first but Milo Greene is soon to be headlining their own sold out shows. Their rich harmonies, energy, and catchy hooks are extremely polished and command our attention. The Los Angeles band has only three songs available on a disc which can be purchased at their shows. They plan to have their first release in April. After their opening set, the line to purchase merchandise was waste deep and a mile long.



            The CIvil Wars

            Joy WIlliams was a California native gone Nashwille and John Paul White is pure Alabama. They began collaborating in 2008 after meeting on a "professional blind date" at a writing camp for more than 20 song writers. They realized during that meeting that they had a spark and would soon form the folk-retro-country pop blend, The Civil Wars. Spoiler alert: although many believe them to be, they are not married and are not even romantically involved. Hard to believe given their amazing chemistry on stage and perfect harmonies.
            The name The CIvil Wars stems from writing about conflicts that arise as part of being a couple. The pair think that this topical writing would be difficult to accomplish successfully if they were actually married (not to mention keeping the relationship intact).

            I was too far back to get a great video of the Civil Wars reinvention of "I Want You Back" so check this version out from a show at the Tin Angel in Philadelphia - it really shows the extreme talent of this dynamic duo:

            The set consisted of several cover songs including: "Disarm" by The Smashing Pumpkins, "Billie Jean", "Dance Me to the End of Love" by Leonard Cohen, and "I Want You Back", Jackson 5 of course. Their next album could just consist of covers which they truly render as their own. On another note, John Paul looks like a montage of Johnny Depp and Jack White according to my friend Amy. Having compared and contrasted online, I have to agree (I wonder who John Paul's mother is?). There are essentially no criticisms of the show except, if we have to reeeeeachhhh for one, Joy's "bangra-esque" hand dancing. I have said it before and unfortunately will likely say it again, when a singer does not have a guitar around the neck or is not at the piano, it is difficult to know what to do with the body and hands. To be honest, this bothered Amy more than me. What bothered me the most at this show was the none stop loud talking by everyone near us. Can someone please explain why people come to a concert to talk? Shouldn't folks be going to concerts to listen? And if it is necessary to speak during a performance use "inside voices" that are barely audible? Puleese people, I am begging you spare me the need to "shush" and the need to blog about this pervasive rude behavior. Take responsibility (if this is you) and do not blame me for calling you out. Enough said.

            The show get's a 5 out of 5 guitar rating. Great sound, perfect harmonies, and a fantastic opening act. I just regret that I missed The Civil Wars at Schubas.

            Rachael Yamagata and Mike Viola at the Logan Square Auditorium on 11/8/11

            I cannot even remember how I first heard of and listened to the now 34 year old Rachael Yamagata. It was a time after she wrote her phenomenally amazing soulful and dark album, Happenstance, and after her 6 year gig with the Chicago band, Bumpus. This is exceptionally unfortunate for me (and it is always about me) since I missed 6 years of opportunity to see her performing live in Chicago. I have no choice now but to see her once every 5 years or so. I did catch her after her release of Elephants.... Teeth SInking into Heart in 2008 at the Lakeshore Theatre on Belmont (cool venue actually).

            Through the help of her fan base and Pledgemusic, and (paraphrased from her website) "the unused stash of money my father put away for my wedding" (she is so self-deprecating), Rachael was able to fund her latest project, Chesapeake. She recorded the entire album, on her own label, after converting the home of one of her collaborators into a studio. As expected, this release continues her chronicles of the dark side of love.

            Tonight's show was at a very interesting venue, The Logan Square Auditorium in of course Logan Square. The space is something you would expect to go to for a high school dance. High ceilings, molding, large gymnasium like floors. We were able to stand up close and personal for the show and the sound was great despite the ceiling height and fairly large room size. When a new album is released, usually that is what you hear most of. Rachael, true to form, did not use the opportunity to overplay her new music. She really balanced her old beloved tunes with a new song sprinkled in.
            She is so down to earth on stage and although great at banter, she is also comfortable with silent pauses never filling the air with unnecessary chatter. The show was great, deep, emotional, fulfilling, hopeful. It was great to have Rachael back in town.
            The venue and performance gets a 5 out of 5 guitar rating. Everything was just perfect, what can I say.

            Side note: If you are lucky to see a show at this theatre, there are two close by restaurants - Lula's Cafe and Dunlay's. The other good news is that there is metered parking until 9pm.

            ASSUMING YOU CARE, MY DAY WENT SOMETHING LIKE THIS:

            6:30 am: Cursed at the alarm clock, woke up, packed kids lunches got breakfast on table, walked and drove kids to school.
            8:30 am: Got myself dressed, put lots of under eye cover cream on, and drive downtowne to educational (work) conference until 2:00 pm.
            2:45 pm: Picked up kids from school and bought birthday present for daughter's friend who is turning 9.
            3:15 pm: Fed son snack before hockey and took daughter to birthday party.
            4:45 pm: Went back home, threw in a load of laundry and got on treadmill for 45 minutes (give or take but who is keeping track?).
            6:30 pm: Went to pick up daughter from party, had glass of wine with mothers who were also picking up there over sugared and pizza fed daughters.
            7:45 pm: Went home, drank two large cups of Starbuck's Italian Roast (home brewed).
            8:00 pm: Had friend and daughter over from 8 until 10pm (to chat about dissatisfaction with our kids schools, grading, and other things we have absolutely no control over, and drink more coffee).
            9:45 pm: Grabbed "bar bag", cell phone, car keys, ID (for the Po Po in case I am pulled over for speeding and to prove that I am decades over 21 when I get to the bar).
            10:00 pm: Left comfort of warm home to meet my friend Becca at Reggie's (on the coldest night of 2012) at 10:30 pm after driving my visiting friend and her daughter home.
            (And the bright light at the end of my humdrum day...unless you thought the other parts sounded fun)
            11:00 pm: Stood up by the stage, grooved and danced for one hour to a little known but most excellent band, Mathien.
            1:00 am: Arrived home, blogged about how seeing Mathien was the light at the end of the tunnel of my already oh so exciting yet typical day. Hallelujah Mathien! (How else could I get though the monotony of the day to day living experience?).

            According to the song "Lettuce Head" from Mathien's latest release The Night I was an Alpha Male, "If you knew me then, you really did not know me at all. If you know me now, you should get to know me better". So: If you did not know them then, you should get to know Mathien now or if you knew them, you should definitely get to know them better.

            This is my second time seeing Mathien and this talented band has been consistently fun, energetic, and completely engaging. The show was well worth guzzling coffee for in order to keep oneself awake to make it to an 11 pm show (even after starting your day at 6:30 am).

            Before I forget, parking for Reggie's was easy breezy. I secured free rock star parking directly across from the venue at 10:30 pm. Normally you could leave your jacket in the car and run across the street if it were not -30 degrees. Another bonus is that there is an incredible record store next door to Reggie's with tons of used CDs, t-shirts and albums. If I had more time to browse I could have found much long lost and new music. Reggie's also serves food until midnight!

            Friday night, The Boss & the E Street Band finally make it to Wrigley Field. Only about 1 hour late. It was cold and windy and I was FREEZEing. But Bruce got the fans warmed up quickly. Great concert with 28 songs on the set list.
